Talk About Lux provides this website, including all information, tools, products and Services available through the Site, subject to your acceptance of the terms, conditions, policies and notices stated herein.

By visiting our Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these terms and conditions (“Terms of Service”, “Terms”), including any additional terms, conditions and policies referenced herein and/or available by hyperlink. SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION; ORDER ACCEPTANCE

All orders are subject to acceptance by Talk About Lux, product availability, successful payment or payment authorization where applicable, verification of the information provided with the order and our ability to deliver the order to the specified destination.

A contract of sale is formed when we accept the order and approve it for fulfilment or dispatch the relevant product, whichever occurs first.

Before acceptance, we may decline or cancel an order where reasonably necessary, including where:

a product is unavailable or cannot be sourced;
there is an obvious pricing, product information, availability or technical error;
payment is declined, cannot be authorized or is identified as potentially fraudulent;
information provided with the order is incomplete, inaccurate or cannot reasonably be verified;
we are unable to deliver to the requested address or destination;
legal, regulatory, customs, carrier or logistical restrictions prevent fulfilment;
the order reasonably appears to involve fraud, misuse, unauthorized resale or other activity inconsistent with these Terms.

We may limit quantities purchased per person, household, account or order where reasonably necessary. These restrictions may include orders placed using the same customer account, payment method, billing address or shipping address.

We reserve the right to limit or prohibit orders that reasonably appear to be placed for unauthorized commercial resale or distribution.

If we cancel or change an order, we may notify you using the email address, telephone number or other contact information provided with the order.

If payment has already been collected for an order or item that we cannot fulfil, the corresponding amount will be refunded using the original payment method, unless another lawful arrangement is expressly agreed with you.

Where an order contains multiple products and only part of the order cannot be fulfilled, we may contact you regarding partial fulfilment, an appropriate alternative where available, or cancellation and refund of the unavailable item.

You agree to provide current, complete and accurate purchase and account information and to update relevant information where necessary so that we can complete transactions and contact you regarding your order.

SECTION 11 - PAYMENT IN INSTALLMENTS WITH TBI BANK

TalkAboutLUX.com provides eligible Users with the opportunity to purchase goods using consumer credit granted by TBI Bank EAD (“the Bank”), subject to the Bank's applicable conditions.

(1) Application Conditions

A person may apply for consumer credit where they meet the eligibility requirements established by the Bank, including applicable age, residency and identification requirements.

The consumer credit available through the Site may generally be:

Amount: from €75 to €5,000;
Repayment period: from 3 months to 24 months.

The exact available amount, repayment period, interest, APR, fees and other credit conditions are determined by TBI Bank and are displayed to the User during the credit application process.

A credit application is initiated online through TalkAboutLUX.com by selecting the applicable payment in installments with TBI Bank option during checkout.

(2) Purchase in Installments

If you wish to purchase goods using consumer credit:

the total eligible value of a single order must be at least €75;
the maximum total eligible order value is €5,000;
installment payment applies to the entire eligible order and cannot be selected for only part of the goods within the same order unless the checkout expressly provides otherwise;
you must apply to the Bank for consumer credit and the Bank must approve the application;
the available repayment options are generated based on the final eligible value of the order and the conditions provided by the Bank;
where supported, you may apply through a registered customer account or as a guest;
the Bank may contact you directly and manages the approval and credit-granting procedure under its own conditions and procedures.

TalkAboutLUX.com can provide information regarding the status and fulfilment of your order but does not determine or control the Bank's decision regarding your consumer credit application.

Goods purchased using TBI Bank financing will be processed for delivery after the Bank confirms to Talk About Lux that the applicable financing has been approved and the necessary conditions for payment of the order have been fulfilled.

If the Bank does not approve the consumer credit application, the relevant order will not be fulfilled using that payment method. You may place a new order using another available payment method.

Where a purchase financed through TBI Bank is lawfully cancelled, withdrawn from or refunded, any amounts relating to the financed purchase may be returned directly to the Bank where required by the financing arrangement and applicable law. Matters relating to the adjustment, termination or settlement of the consumer credit agreement are handled between the User and the Bank in accordance with the credit agreement and applicable law.

(3) Consumer Credit Conditions

All conditions and procedures relating to consumer credit, including eligibility, approval criteria, repayment period, number and amount of installments, interest, fees, APR, arrears, default and other credit conditions, are determined by TBI Bank EAD.

Any credit information displayed through the Site or the integrated credit calculator is provided based on information and conditions determined by the Bank.

TalkAboutLUX.com does not determine the credit approval criteria, interest rates, APR, fees or other financing conditions and cannot renegotiate these conditions on behalf of the Bank.

TalkAboutLUX.com is not the lender and is not a party to the consumer credit agreement. The consumer credit agreement is entered into between the User and TBI Bank, and rights and obligations arising specifically from that credit agreement are governed by the agreement with the Bank and applicable law.

(4) Personal Data

For the purposes of applying for consumer credit, you may provide Personal Data directly to TBI Bank. The Bank processes such Personal Data in accordance with its own privacy policy and applicable data protection law.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on the Site or in the Service may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability.

We reserve the right to correct errors, inaccuracies or omissions and to change or update information at any time.

Where an obvious pricing, product, availability or technical error affects an order, we may contact you and, where permitted by applicable law, correct or cancel the affected order.

Nothing in this Section limits any mandatory rights available to consumers under applicable law.

SECTION 12.1 - PRODUCT SAFETY & COMPLIANCE

All products sold through TalkAboutLUX.com are sourced through verified supply and distribution channels.

As an online retailer operating in the European Union, we comply with the applicable obligations under the General Product Safety Regulation (EU) 2023/988 (“GPSR”) and other applicable product safety legislation.

We take reasonable measures within our role in the supply chain to ensure that products offered for sale comply with applicable product safety, traceability, information and labelling requirements.

Where required and applicable, relevant product identification, manufacturer, responsible person, safety or warning information is provided with the product and/or through the applicable product information made available for distance sales.

We cooperate, where required, with manufacturers, suppliers and competent authorities regarding product safety investigations, corrective measures, recalls and safety alerts.

Subject to the above and to the maximum extent permitted by applicable law, Eastern Lux Trading Ltd, Talk About Lux, our directors, officers, employees, affiliates, agents, contractors, suppliers, Service providers and licensors shall not be liable for indirect, incidental, special, punitive or consequential losses arising from the use of the Site or Services where such liability may lawfully be excluded.

We are not responsible for losses caused solely by circumstances outside our reasonable control, including failures of third-party networks, carriers, payment providers or other independent service providers, except where applicable law provides otherwise.

Where applicable law does not permit a particular exclusion or limitation of liability, our liability shall be limited only to the maximum extent permitted by that law.

SECTION 15 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless EASTERN LUX TRADING LTD, Talk About Lux and our affiliates, officers, directors, employees, agents, contractors, licensors, Service providers, subcontractors and suppliers from third-party claims, losses, liabilities or reasonable legal costs arising directly from:

your material breach of these Terms;
your unlawful use of the Site or Services;
your violation of applicable law;
your infringement of the rights of a third party.

This Section does not apply to the extent that a claim, loss or liability results from our own breach, negligence, unlawful conduct or other matter for which liability cannot lawfully be excluded.

Nothing in this Section limits any mandatory consumer rights.

SECTION 16 - SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law.

The invalid or unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.

The rights, obligations and liabilities of the parties that arose before termination shall survive termination where their nature or applicable law requires them to do so.

These Terms of Service remain effective for as long as you access or use the Site or Services.

You may stop using the Services at any time.

Termination or restriction of access does not affect amounts lawfully due or rights and obligations arising from orders or transactions entered into before termination.
